These Terms & Conditions ("Terms") govern your use of Publiqo, a product of Digiturtle Marketing OPC Private Limited ("we", "our", "us"). By accessing or using our platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using any Publiqo services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use the platform.

2. Description of Service

Publiqo is an AI-powered content automation platform that enables users to:

Research topics and curate content sources automatically.
Generate text and visual content using AI models (via user-provided API keys).
Schedule and publish content to connected social media platforms.
Manage brand guidelines, templates, and content pipelines.

3. Account Responsibilities

You must provide accurate information when creating your account.
You are responsible for maintaining the security of your account credentials.
You are responsible for all activity that occurs under your account.
You must be at least 18 years old to use Publiqo.

4. API Keys & Third-Party Services

Publiqo operates on a Bring Your Own Key (BYOK) model:

You provide your own API keys for AI providers (Anthropic, OpenAI, SiliconFlow, etc.).
You are responsible for the costs incurred on those third-party services.
We store your keys encrypted and use them solely to perform actions you initiate.
You must comply with the terms of service of each third-party API provider.

5. Social Media Publishing

When you connect social media accounts (Instagram, Facebook, LinkedIn, Twitter/X):

You authorize Publiqo to publish content on your behalf to those platforms.
You are solely responsible for the content published through your account.
You must comply with each platform's terms of service and community guidelines.
You can revoke access at any time by disconnecting accounts in Settings.
We are not liable for any consequences of content published to your social accounts.

6. Content Ownership

You retain ownership of all content you create, upload, or generate through Publiqo.
You grant us a limited license to store, process, and transmit your content solely to provide the service.
AI-generated content belongs to you, subject to the terms of the underlying AI provider.
We do not claim ownership of your brand assets, templates, or generated outputs.

7. Prohibited Use

You agree not to use Publiqo to:

Generate or publish content that violates any applicable laws.
Create spam, misleading, or deceptive content.
Impersonate others or misrepresent your identity.
Distribute malware or attempt to compromise the platform's security.
Violate the intellectual property rights of others.
Generate harmful, hateful, or abusive content.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may:

Perform maintenance that temporarily affects availability.
Modify or discontinue features with reasonable notice.
Suspend accounts that violate these Terms.

9. Limitation of Liability

To the maximum extent permitted by law:

Publiqo is provided "as is" without warranties of any kind.
We are not liable for any indirect, incidental, or consequential damages.
We are not responsible for content accuracy of AI-generated outputs.
We are not liable for actions taken by social media platforms on your accounts.
Our total liability shall not exceed the amount you paid us in the last 12 months.

10. Termination

Either party may terminate this agreement at any time. Upon termination:

Your access to the platform will be revoked.
We will delete your data within 30 days (unless legally required to retain it).
Connected social media tokens will be revoked.

11. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or in-app notification. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of New Delhi, India.
